1. General Provisions

1.1. These Terms of Service govern the use of the online store at bio2you.co.uk, the purchase of goods, payment, delivery, withdrawal rights, returns, and the liability of the parties.

1.2. The seller is SIA B2Y, registration No. 40103243404, VAT No. LV40103243404, registered address: "Vismaņi k-5", Mārupes novads, LV-2167, Latvia, EU.

1.4. By placing an order on bio2you.co.uk, the buyer confirms that they have read and agree to these Terms.

1.5. These Terms apply to the extent that they are not limited or replaced by mandatory applicable laws regarding consumer protection, distance contracts, lack of conformity of goods, and other related matters.

2. Goods, Prices and Availability

2.1. All prices are indicated in euro (EUR) and include the applicable value added tax.

2.2. Product information, characteristics, usage instructions, volume, composition, availability and price are indicated next to the respective product.

2.3. We reserve the right to change prices, product assortment, promotional conditions and availability at any time. Such changes shall not apply to orders already confirmed and paid for before publication of the relevant changes.

2.4. If, after receipt of the order, the ordered product is unavailable or objectively cannot be delivered, we will inform the buyer and agree on fulfilment, replacement, partial fulfilment or refund.

3. Placing Orders and Conclusion of Contract

3.1. The buyer may place an order with or without creating a customer account.

3.2. When placing an order, the buyer must provide truthful, accurate and complete information about themselves, the delivery address and other data necessary for order fulfilment.

3.3. The purchase contract is deemed concluded when the buyer has placed the order and received an order confirmation from the seller.

3.4. The seller has the right to refuse to fulfil the order if there are objective grounds to believe that the information provided is false, payment has not been received, the order is fraudulent, or fulfilment is impossible for reasons beyond the seller's control.

4. Payment

4.1. Payment may be made by bank card (Visa, Mastercard), Apple Pay, Google Pay, Shop Pay or internet banking using the payment solutions available in the online store.

4.2. Internet banking payments for Latvia, Lithuania, Estonia and Finland are processed through MakeCommerce (Maksekeskus AS). Card payments are processed through Shopify Payments.

4.3. The order is processed after successful receipt or confirmation of payment.

4.4. Personal data necessary for payment processing is transmitted to the respective licensed payment service provider.

5. Delivery

5.1. Delivery is provided to Latvia, Lithuania, Estonia, Finland and other European Union countries in accordance with the delivery methods available in the online store.

5.2. Depending on the delivery address and selected service, parcel locker delivery, courier delivery or local pickup may be available.

5.3. Orders are usually dispatched on the next business day after payment is received.

5.4. Estimated delivery times after dispatch: parcel locker delivery in the Baltics usually 2–3 business days; courier delivery usually 3–4 business days. International delivery times may vary.

5.5. The delivery price is indicated during checkout before payment is made.

5.6. Free shipping is available for orders over EUR 39 to Latvia, Lithuania and Estonia, and over EUR 49 to Finland.

5.7. The buyer assumes the risk of accidental loss of or damage to the goods from the moment the goods are handed over to the buyer or the person designated by the buyer, insofar as applicable law does not provide otherwise.

5.8. If the buyer fails to collect the shipment within the time limit specified by the carrier, the shipment may be returned to the seller. The buyer shall bear the cost of re-shipment.

6. Right of Withdrawal

6.1. The consumer has the right to withdraw from the distance contract within 14 calendar days without giving any reason.

6.2. The withdrawal period is calculated from the day on which the consumer or a third party indicated by the consumer, other than the carrier, acquires possession of the goods.

6.3. To exercise the right of withdrawal, the consumer must send the seller a clear notice of the decision to withdraw within 14 days by email to ecommerce@bio2you.eu.

6.4. After sending the notice of withdrawal, the consumer must return the goods without undue delay and no later than within 14 days.

6.5. The direct cost of returning the goods shall be borne by the buyer, unless applicable law provides otherwise.

7. Exceptions to the Right of Withdrawal

7.1. The right of withdrawal may not be exercised in cases where it is excluded by applicable law.

7.2. In relation to cosmetic or body care goods which are sealed for health protection or hygiene reasons, the right of withdrawal does not apply if the sealed packaging has been opened after delivery.

8. Refund Terms

8.1. If the consumer has lawfully exercised the right of withdrawal, the seller shall refund all payments received no later than within 14 days from receipt of the withdrawal notice; however, the seller is entitled to withhold the refund until the returned goods or proof of their dispatch has been received.

8.2. The refund shall be made using the same means of payment used for the initial transaction, unless the parties have agreed otherwise.

8.3. The consumer is liable for any diminished value of the goods if the goods have been used more than necessary to establish their nature, characteristics and functioning.

9. Damaged or Non-Conforming Goods

9.1. If the buyer receives damaged goods or goods that do not correspond to the order, the buyer must notify the seller as soon as possible at ecommerce@bio2you.eu, attaching photographs and the order number where possible.

9.2. If only the outer packaging is damaged but the goods themselves are not, this alone shall not constitute grounds for a refund.

9.3. If the goods are damaged, non-conforming or the damage falls within the seller's or delivery partner's responsibility, the seller shall provide a remedy in accordance with applicable law, including repair, replacement, price reduction or refund.

10. Buyer's Obligations

10.1. Before using the goods, the buyer must familiarise themselves with the product description, composition, instructions for use and warnings.

10.2. The buyer must take into account their individual characteristics, including allergies, sensitivities or other risks of reaction associated with the use of cosmetic products.

10.3. The seller shall not be liable for consequences arising where the goods have been used contrary to their intended purpose or ignoring instructions.

11. Intellectual Property

11.1. All rights to the content of the online store, including texts, design, images, logos and other materials, belong to the seller or the respective rights holders.

11.2. Without prior written permission, copying, republishing or modifying such content for commercial purposes is prohibited.

12. Personal Data

12.1. Personal data is processed in accordance with the Privacy Policy published on bio2you.co.uk.

13. Dispute Resolution and Applicable Law

13.1. These Terms shall be governed by the laws of the Republic of Latvia.

13.2. Any disputes shall primarily be resolved through negotiations.

13.3. If the dispute cannot be resolved through negotiations, the consumer has the right to apply to the Consumer Rights Protection Centre of the Republic of Latvia or to a court in accordance with applicable law.

13.4. Consumers within the European Union may also seek resolution through the competent national authorities or courts.

14. Amendments

14.1. The seller has the right to amend these Terms at any time. The new version enters into force on the date of publication.

14.2. Orders shall be governed by the version of the Terms that was in force at the time the order was placed.
